The motion presented on behalf of Tevin Sithanen was debated in the Curepipe court on Wednesday, December 17, 2025. The son of Rama Sithanen, former governor of the Bank of Mauritius, is seeking to have the interim charge against him for "breach of the Information and Communication Technologies Act" dismissed.

This interim charge stems from the online dissemination of an audio recording allegedly attributed to Tevin Sithanen. In this recording, he reportedly made threatening remarks towards Aditi Boolell and Stéphane Adam, executives at Menlo Park Ltd.

During the hearing on December 17, the defense argued that there is no reasonable suspicion justifying the continuation of this interim charge. They pointed out that the original audio recording has never been produced by the complainant, Aditi Boolell, who relied on a file already circulating on social media, which could have been altered, manipulated, or generated by artificial intelligence.

Police Assistant Superintendent Balmick Dussoye, the lead investigator in this case from the Anti-Money Laundering unit, was questioned by Me Rajeenee Segobin, Senior State Counsel, and then cross-examined by Me Imtihaz Mamoojee, Senior Counsel. He claimed that the "Quintel report does not exonerate Tevin Sithanen."

Discussions focused on a report from Quintel Intelligence, a legal intelligence provider, submitted by Tevin Sithanen to the police. ASP Balmick Dussoye stated that the authenticity of this report has yet to be established. He specified that the opinion of the Director of Public Prosecutions (DPP) has been sought regarding this matter, and his unit is still awaiting a response.

The senior officer added that while the report contradicts the accounts of Aditi Boolell and Stéphane Adam, it remains technical and does not exonerate the suspect at this stage. The pleadings regarding the motion have been scheduled for January 23, 2025.

Partial Closed Hearing

At the start of the case at 11 a.m. before Magistrate Shavina Jugnauth, the police officer present in the courtroom informed journalists that they were not allowed to attend the proceedings, per the magistrate's instruction. The doors were closed, and the hearing initially took place behind closed doors. However, around 11:55 a.m., the press was allowed to enter the courtroom. The DPP did not insist on a travel ban against Tevin Sithanen, allowing him to travel freely.
