What is Privacy?

- The socio-cultural aspect must also be considered. What is accepted in a liberal society can be very taboo in a conservative society that is deeply attached to traditional and family values.
- Moreover, the Mauritian Civil Code provides, under Article 22, for the respect of privacy but does not give a precise definition of it.
- Another fundamental principle is that of consent. This principle weighs heavily when determining if an action has violated a person's privacy.
- Ultimately, privacy is the ability for a person to isolate themselves to protect their well-being.
What is meant by Public Life?
- Conversely, public life concerns everything that is known to the general public.
- If a person seeks public attention or support to succeed, they expose themselves to the risk of aspects of their private life becoming public.
- Their behavior is then closely monitored by the population, to whom they may be accountable, depending on the society in which they operate.
- As long as their behavior is deemed acceptable, there is no issue. But if their actions are socially or legally reprehensible, the situation can become problematic.

"In Mauritius, we are very attached to ancestral values. Therefore, those involved in politics and other dignitaries must exercise vigilance. Sensationalism often dominates this sphere. The press and social media play an important role under the guise of freedom of expression, which can lead to the downfall of a public figure or dignitary," explains Me Siven Tirvassen.
What is the Difference Between Private Life and Public Life?

"Regarding public life, there is nothing wrong with it being exposed to the general public. However, if an individual believes that their privacy has been disclosed without their consent, they can take civil action to seek damages. The amount claimed can be significant, but it is up to the judge or magistrate to determine if there has been harm to the individual's reputation and to set compensation. In any case, if a person's privacy rights are violated, there can be repercussions on their reputation, professional or political career," explains Me Siven Tirvassen.
Does a Public Figure Have the Right to Privacy?
- It is true that a public figure is very exposed to criticism, but they also have the right to privacy.

The Flaws in Legislation
- It is possible to file a police report for criminal defamation, but often, the interpretation of what constitutes criminal defamation is problematic.
