PRB 2026: The State Opposes the Suspension of the Option Form

The constitutional complaint challenging the implementation of the 2026 Pay Research Bureau (PRB) report was brought before Chief Justice Bibi Rehana Mungly-Gulbul at the Supreme Court on Monday, March 16, 2026. The case has been postponed to March 23, 2026.

During the hearing, Me Doorgesh Kumar Manikaran, Acting Deputy Chief State Attorney, representing the State and the Ministry of Public Service and Administrative Reforms, requested a postponement to clarify the State's position. He stated, however, that he opposes the request to temporarily suspend the requirement for civil servants to sign the Option Form while the case is being heard.

The complainants are Rishiraj Persand, ICT Support Officer at the Ministry of Education and President of the State and Other Employees Federation, and Amarjeet Seetohul, Senior ECG Technician at Sir Seewoosagur Ramgoolam Hospital and President of the Ministry of Health Employees Union.

They contest the phased implementation of salary increases proposed by the PRB and the requirement to sign the Option Form by March 18, 2026, which they deem to be "coercive." They are seeking to have several circulars and this form declared unconstitutional.

The complainants were represented by Me Roshi Bhadain, Naina Dreepaul, and Yash Balgobin, attorneys.
