Electronic Transactions: A Bill to Modernize and Expand the Legal Framework Soon in Parliament
The Electronic Transactions (Amendment) Bill will be introduced in the National Assembly. The purpose of this bill is to amend the current law to modernize and expand the legal framework governing electronic transactions in Mauritius. It will update provisions related to electronic signatures by adopting a technology-neutral standard based on reliability. It will also recognize the validity of contracts formed or executed through automated messaging systems and introduce a framework for the legal recognition of transferable electronic records.
These provisions, based on international principles of functional equivalence, aim to facilitate the secure dematerialization of documents traditionally issued on paper. These amendments will strengthen legal certainty, promote paperless commerce, and enhance cross-border transactions, while streamlining business operations within the digital economy.
